A key difference would be how the data is stored. In TCP IP you would actively search for the bad stuff out there somewhere. But without BIP110 the bad stuff gets put on the blockchain outside of your control and you hold it locally on your node forever.
So I get your argument, yes with TCP IP I could access bad stuff, but I am not hosting it. With non-financial data being added to the blockchain, all the sudden you have illicit content stored on a device in your own home on your network. Good luck defending that. It's a complete change in precedent. Now node runners are storing shit that's illegal in most jurisdictions and immoral, disgusting. See how that goes. I don't even care about the legality piece. All the sudden you cannot run a node, either because your local authority bans it or the spam data gets too big for you to afford the storage. Good luck.
