It's up to a jury, and those who would track them down so a jury has anything to hear.
While they should see a jury if caught, I'd be lying if I said I want to see the idea that Bitcoin can't be used privately given any more steam.
It is admittedly harder to get much of an anonymity set when you're trying to hide hundreds of bitcoin though.
